Chandigarh, 7th April,
2016: It has been
made to appear to Ajit Balaji Joshi, IAS, District Magistrate, Chandigarh that
domestic servants and other domestic helpers often have a large part to play in
crime and that they are sometimes themselves the perpetrators or active
conspirators in committing of offences.
If, antecedents of domestic servants are not verified, in the event of
any crime taking place involving them, there is every apprehension of grave
danger to human life and safety and injury to public property besides breech of
peace and disturbance of public tranquility.
It has
been noticed that many residents do not cooperate with the police, and are
reluctant to give details necessary for verification. Under these
circumstances, Sh. Ajit Balaji Joshi, IAS, District Magistrate, Chandigarh, am
of the opinion that some check should be put on
residents/landlords/tenants/commercial establishments so that anti-social
elements in the guise of ordinary domestic servants/helpers/maid servants may
not pose a threat to their own employers and to other citizens and that
immediate action is necessary for prevention of the same.
Therefore,
Sh. Ajit Balaji Joshi, IAS, District Magistrate, Chandigarh in exercise of the
powers vested with him under section 144 Cr.P.C. do hereby order as on
emergency measure that the residents of Union Territory, Chandigarh, including
land-lords, tenants and those running commercial establishments shall not
employ any domestic servant, helper, part time maid servant, unless his/her
particulars are furnished to the Station House Officer (S.H.O.) concerned in
writing in the form designed by the local police. Any breach of this order would invite action
under section 188 of the Indian Penal Code.
In view of
the emergent nature of the order, it is being issued ex-parte and is addressed
to the public in general. This order shall come into force with effect from zero hours on 08.04.2016 and
shall be effective for a period of sixty days up to and including 06.06.2016.
