Guidelines to regulate E-Rickshaws / E-Cart

Chandigarh, 1st August, 2017: In supersession of this Administration’s Notification No. H-III(7)-2017/5393, dated 14.3.2017 and in pursuance of the notifications No. G.S.R. 709(E), dated 08.10.2014, G.S.R. 27(E), dated 13.01.2015, S.O. 2590 (E), dated 08.10.2014, the Motor Vehicles (Amendment) Ordinance, 2015 No. (2 of 2015), dated 07.01.2015 and S.O. No. 2812(E), dated 30.8.2016, the Administrator, Union Territory, Chandigarh is pleased to notify the following procedural guidelines to regulate E-Rickshaws / E-Cart in Union Territory, Chandigarh;
1.       “E-Rickshaw / E-Cart” shall have the same meaning as defined in the notification No. GSR 709(E), dated 08.10.2014, No. GSR 27(E), dated 13.01.2015, S.O. 2590(E), dated 08.10.2014, Motor Vehicle (Amendment) Ordinance, 2015 No. (2 of 2015), dated 07.1.2015 and S.O. No. 2812 (E), dated 30.8.2016 done by the Ministry of Road Transport and Highways, New Delhi or further amendments as done from time to time in this regard.
2.       The provisions, procedures and fee for the purpose of licensing and registration of E-Rickshaw / E-Cart shall be as per the amendments made in Motor Vehicle Act / Central Motor Vehicle Rules by Ministry of Road Transport and Highways, New Delhi, in this respect, vide its notifications mentioned in para (1) above.
3.       A separate registration series CH01TE shall be assigned to the E-Rickshaws / E-Carts by the State Transport Authority, U.T., Chandigarh.
4.       Rickshaw / E-Cart shall ply within territory of U.T., Chandigarh on all the roads except V-1, V-2 and V-7.  However, they shall be allowed to access and use crossing junctions / round – abouts on all roads.
5.       The penalty clauses for traffic offences as provided in Central Motor Vehicle Rules, 1989 and Chandigarh Motor Vehicle Rules, 1990 shall be applicable to them as in the case of transport vehicles.
6.       The model of E-Rickshaw / E-Cart to be registered in Chandigarh must have type approval certificate from designated testing agencies as prescribed by the Ministry of Road Transport and Highways, New Delhi.
7.       Number of E-Rickshaws and E-Carts to be registered in Chandigarh shall be regulated by State Transport Authority, U.T., Chandigarh from time to time so that their supply / availability is not more than the actual demand for them.
8.       The vehicle must be equipped with a first aid box and fire extinguisher.
9.       The helpline number 1073 of Traffic Police, Chandigarh shall also be displayed on both inside and outside the vehicle.
10.     The driver shall wear the uniform in Grey Colour or as prescribed by the State Transport Authority, U.T., Chandigarh.
11.     The vehicle shall bear a yellow colour reflective strip of appropriate width on its rear and along the sides.
12.     The owner shall dispose of the used batteries only through an authorised e-waste disposal agency.
13.     The owner / driver of E-Rickshaws / E-Carts shall be bound to follow the Parking Policy as notified by Chandigarh Administration.
14.     The passengers of E-Rickshaw and E-Cart shall board and alight only from left side of the vehicle instead of both the sides.

15.     The owner / driver of E-Rickshaws and E-Carts shall be bound to follow the rules of the Road Regulation, as notified from time to time.
