Order under Section 144 of the Cr.P.C

Chandigarh, 15th October, 2018: It has been made to appear to Sh. Sachin Rana, I.A.S. , District Magistrate, Chandigarh that during festival season, bursting of firecrackers and other fire-works, causes a lots of noise and air pollution, which is likely to create annoyance and occurrence of injury to health of general public. Hence, there is an urgent need to prevent the same by restricting the use of firecrackers and other fire-works, within Chandigarh.
Therefore, the District Magistrate, Chandigarh, exercising the power/authority vested under Section 144 of the Cr.P.C.,  do hereby, orders as following:
1.The bursting of firecrackers and other fire-works within the territorial limits of U.T., Chandigarh, shall be allowed between 05:00 P.M. to 08:00 P.M. on Dusshehra day, i.e. 19th October, 2018, only.
2.The bursting of firecrackers and other fire-works within the territorial limits of U.T., Chandigarh. Shall be allowed between 06:30 P.M. to 09:30 P.M. on Diwali day, i.e. 7th November, 2018 only.
3.The bursting of firecrackers and other fire-works within the territorial limits of U.T., Chandigarh, shall be allowed between 06:30 P.M. to 09:30 P.M. on Gurupurab, i.e. 23rd November, 2018, only.
4.There shall be complete ban on bursting of firecrackers and other fire-works at any time and day, other than the above, within the territorial limits of U.T., Chandigarh, w.e.f. zero hours on 26.09.2018 up to and including 24.11.2018.
5. The sale of firecrackers by the temporary licensees granted by the office of the under-signed shall only be in the areas, which are designated in the temporary licence and no temporary licensee shall sell firecrackers or market them at any other place except the earmarked/designated area.
6.The manufacturing, sale or use of firecrackers generating noise level exceeding 125 dB (A) or 145 dB (C) pk at 4 meters distance from the point of bursting & for individual fire cracker constituting the series, the said limit reduced by 5 log 10 (N) dB, where N= number of crackers joined together, shall be banned.
7.Every manufacture shall on the box of each firecracker, mention details of its chemical contents and that it satisfies the requirement as laid by the Department of Explosives.
