Draft Bye Laws- Chandigarh Water Supply Bye-Laws 2011



Chandigarh, 27th November 2018: The Municipal Corporation, Chandigarh in exercise of the powers conferred under Section 399 of the Punjab Municipal Corporation Act, 1976 as extended to the Union Territory, Chandigarh by the Punjab Municipal corporation Law (Extension to Chandigarh) Act,  1994 (Act No. 45 of 1994), intends to amend the Chandigarh Water Supply Bye-Laws 2011 as amended from time to time and as in accordance with the provision of sub-section (1) of Section 401 of the Punjab Municipal Corporation (as extended to UT Chandigarh) Act, 1994, read with sub section (2) of section 7A of the capital of Punjab (Development &Regulation) Act, 1952, the Administrator UT Chandigarh after according approval to the same propose to issue the draft of notification which is hereby published for information of the persons likely to be affected thereby.
Draft BYE-LAWS
Short Title:-
1.     These Bye-laws may be called the Chandigarh Water Supply Bye-laws, Amendment 2018.
2.     These shall come into force from the date of its publication in official gazette.
3.     In the Chandigarh Water Supply Bye-Laws 2011 as amended in 2016 (hereinafter referred to as said bye laws) for clause 10 the following shall be substituted as under:
Clause No. 10: Connection Pipeleakage of water line between ferrule to water meter:-
On observing leakage on such points, notice will be served to the consumer asking him/her to get the leakage rectified within a period of 2   days. In case of non compliance, leakage shall be got repaired at the risk and cost of the consumer and the amount so involved will be intimated to the water bill section along with the fine of Rs. 100/- which will be recovered in the ensuring water bill.
The cost of replacement of the damaged and leaking pipes shall be charged at the following rates:
1)    Rs. 2,000/- (including cost of material and labour)  If the Municipal line exists on the road berm adjoining the house.
2)     Rs. 6,000/- (including cost of material and labour) If the Municipal Line exists across the road.
Note: (i) 7% increase per annum w.e.f (1st day of succeeding month after             issuance of notification)
            (ii) Extra cost of road cut to be paid by the consumer as per actual             at site to the road department.
4.     In the  said   bye laws, for clause 45(i), the following shall be substituted as under:
Clause No. 45(i) the Municipal Corporation,  Chandigarh, shall charge the following amount from the owners of the premises within its municipal limits who install tubewells in their premises after obtaining prior sanction form the competent  authority:

Note: (i) If bore of tubewell installed at premises found higher side from the approved sixe, the rate will be charged on penal rate i.e. double of actual bore size till the size will be got revised from the competent authority.

5.     In  the said bye laws, for clause 45(iv), the following shall be substituted as under:
All the vehicles service stations are afforded another, opportunity to install shallow tubewell within three months of issuance of notification, failing which a penalty of Rs. 2.00 lac will be imposed as one time and thereafter Rs. 5000/-per day will be charged till approval of installation of the Shallow Tubewell in their premises.
Note:- All premises where tubewell have been sanctioned for potable water shall get water sample tested for chemical and bacteriological at least once in a monrht from the water works Sector 39,  Chandigarh in public interest. 
6.     In the said bye laws, for clause 47, the following shall be substituted as under:-
No Direct on line water boosting arrangement shall be installed by the consumer. In case, it is found to be installed on the direct water supply system within the premises, the following action shall be taken against the consumer:-
a)     Confiscation of pump/motor for first offence with a fine of Rs. 5000/-

b)    Confiscation of pump/motor with disconnection of water connection with fine for second and subsequent offences: Rs. 10000/-
7.     In the said bye laws, for clause  51, the following shall be substituted as under:-
Clause 51:- Sewer connection charges for release of sewerage connection for the newly constructed buildings: for flats constructed by Chandigarh Housing Board

 Note: Four times the rate of each category to be levied upon on regularization of illegal sewer connection.
Sewerage Cess within the Municipal limits of Chandigarh Municipal Corporation shall be charged at the following rates:
1.      
Residential Building:-
30% of water consumption amount
2.      
Hotels/Commercial Premises, Institutions and other categories:-
30% of water consumption amount
