Transfer of Immovable Property

Chandigarh, 16 th June, 2017: The Hon’ble Supreme Court of India in the case of Suraj Lamps and Industries Vs State of Haryana- SLP(C) No.13197 of 2009 has categorically laid down that “immovable property can be legally and lawfully transferred/conveyed only by a registered deed of conveyance. Transactions of the nature of ‘GPA sales’ or ‘SA/GPA/WILL transfers’ do not convey title and do not amount to transfer, nor can they be recognized as a valid mode of transfer of immovable property. The courts will not treat such transactions as completed or concluded transfers or as conveyances as they neither convey title nor create any interest in an immovable property. They cannot be recognized as deeds of title, except to the limited extent of section 53A of the TP Act. Such transactions cannot be relied upon or made the basis for mutations in Municipal or Revenue Records. Uniform Policy to be Formulated for allotments pertaining to the Discretionary Quota

Chandigarh, 15 th June 2017: It has been noticed that certain allotments pertaining to the Discretionary Quota had been cancelled by Chandigarh Housing Board as the allottees had sold/transferred the allotments on Discretionary Quota as the dwelling units under Discretionary Quota were not transferable under the GPA Policy when it was enacted. Later, the Board relaxed this provision on 11-12.08.2000 & allowed the Discretionary Quota houses to be transferred in favour of the buyers who had bought such Discretionary Quota allotted houses. Before the relaxation, however, certain cases have surfaced where the Discretionary Quota houses were cancelled due to having being sold by the allottees. Since the Board has framed a policy for regularizing cancellations made on the basis of false affidavits, similarly it is hereby ordered that such Discretionary Quota cancellations will also be regularized henceforth. Anti Rabies Campaign in Chandigarh (UT) Villages

Chandigarh, 14 th June 2017: In continuation of Mass Anti Rabies Vaccination programme in Chandigarh (U.T) villages, the SPCA organized the camp in co-ordination with Department of Animal Husbandry, Chandigarh at village Makhan Majra and Raipur Kalan today. On this day 65 dogs which included 42 stray and 23 pets were vaccinated. Working under the guidance of Sh. Ajit Balaji Joshi, IAS, Deputy Commissioner, Chandigarh cum President SPCA, the programme was started on 22 nd May from village Kaimbwala, till date 325 dogs had been vaccinated against Rabies during these camps. Online Single Window System Launched for Ease of Doing Business in Chandigarh

Chandigarh, 14 th June 2017 : Sh. V.P. Singh Badnore, the Governor of Punjab and Administrator, U.T., Chandigarh launched an Online Single Window System for ease of doing business in Chandigarh. Sh. Chandigarh, 14 th June 2017: It has come to the notice of the District Magistrate, U.T., Chandigarh, Sh. Ajit Balaji Joshi that most of the private coaching centers in the city of Chandigarh remain opened from 08.00 A.M. to 03.00 P.M. These coaching centers are involved in the business of giving tuitions to the school children and their tuition timings clashes with the school time of children, which act as a deterrent to children for attending their school. Also, the U.T. Cadre Education Employees Union, Chandigarh had once stated that they are spoiling the future of the children and even preventing the children to go to school.
